These Terms of Use (“Terms”) govern your access to and use of https://margaretchiavini.com/ (the “Site”), operated by Margaret Chiavini (“I,” “me,” or “my”).
By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site is provided for general information about my work as a speaker, author, podcast host, and founder of Monumenta. It may include information about It’s Your Party, Designing Happy, speaking topics, and forthcoming projects.
The Site is for personal, non-commercial viewing unless I agree otherwise in writing.
Content on the Site, including essays, talk descriptions, book descriptions, podcast material, and any discussion of planning, money, legacy, or end-of-life matters, is for general education and inspiration only.
It is not legal, tax, estate-planning, funeral, medical, or investment advice. It is not an offer of securities, banking, insurance, or fiduciary services. My role as a financial-services executive is separate from this Site. Nothing here creates an advisory, client, or professional relationship.
You are responsible for decisions about your life, family, finances, and legal affairs. Consult qualified professionals licensed in your jurisdiction before you act.
Book. It’s Your Party may be sold through Amazon or other retailers. Purchase, shipping, returns, and payment are handled by that retailer under its own terms. I am not the merchant of record for those checkouts unless a page expressly says otherwise.
Speaking. A request through the Site is an inquiry, not a confirmed booking. Dates, fees, travel, and deliverables are set only in a separate written agreement.
Podcast. Designing Happy episodes, when published, may appear on third-party platforms. Those platforms’ terms apply to listening and subscriptions there.
Monumenta. Monumenta is described as forthcoming. Features, availability, and pricing are not guaranteed until a product is publicly released under its own terms.

The Site design, text, photographs, logos (including the MC mark and Designing Happy artwork), graphics, and other content are owned by me or used with permission. All rights reserved.
You may view and print pages for personal reference. You may not copy, modify, distribute, or create derivative works from Site content for public or commercial use without prior written consent, except for brief quotations with credit and a link to the Site, or uses allowed by fair use or similar law.
Trademarks and logos of Amazon, Apple, Spotify, and other third parties belong to their owners.
If you send ideas, stories, press materials, or other content through the Site or email, you grant me a non-exclusive right to use that material to respond and, where relevant, to evaluate a collaboration. I am not obligated to use an unsolicited idea or to keep it confidential unless we have a separate written agreement.

Links to other websites are provided for convenience. I do not control those sites and am not responsible for their content, policies, or practices.
The Site and all content are provided “as is” and “as available.” To the fullest extent permitted by law, I disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

To the fullest extent permitted by law, Margaret Chiavini will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Site or reliance on its content.
Total liability for any claim arising from the Site will not exceed one hundred dollars (US $100).

You agree to defend and hold harmless Margaret Chiavini from claims, damages, and reasonable legal fees arising from your use of the Site, your submissions, or your violation of these Terms.
I may change the Site or these Terms at any time. The “Last updated” date will change when the Terms are revised. Continued use after a change means you accept the new Terms.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Courts located in Nevada will have exclusive jurisdiction, except that I may seek injunctive relief in any jurisdiction to protect intellectual property.
If a provision of these Terms is held unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and me regarding the Site. Failure to enforce a provision is not a waiver.
